Hague System

An industrial design generally constitutes the ornamental or aesthetic aspects of various articles, such as the three dimensional features (e.g., shapes) or two dimensional features (e.g., patterns, lines or colors) of packages, containers, furniture, household goods, lighting equipment, jewelry, electronic devices, and textiles.

The Hague System for the International Registration of Industrial Designs provides a practical business solution for registering up to 100 designs in over 65 territories through filing one single international application.

Effective May 13, 2015, the provisions in Title I of the Patent Law Treaties Implementation Act of 2012 implement the 1999 Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs.

An industrial design can be registered internationally according to the Geneva Act of the Hague Agreement via the World Intellectual Property Organisation (WIPO).

The Hague Agreement governs a system for the international registration of industrial designs that is applicable among its Contracting Parties. It is administered by the International Bureau of the World Intellectual Property Organization (WIPO) located in Geneva, Switzerland.

On April 2, 2015, the U.S. Patent and Trademark Office (USPTO) released the final rules implementing the Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs, better known as the Hague Agreement. The United States will fully implement the Hague Agreement when the rules go into effect on May 13, 2015.

Last week, the U.S. announced that it had deposited its instrument of ratification to the Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs (Hague Agreement) with the World Intellectual Property Organization (WIPO) in Geneva, Switzerland. The USPTO announced that the United States has deposited its instrument of ratification to the Geneva Act of The Hague Agreement with WIPO on February 13th 2015, marking the final step towards the United States joining the Hague System. The treaty will go into effect for the US on May 13th of this year.

In May 2015 the accession of the U.S. and Japan to the Hague System for the International Registration of Industrial Designs took effect. These accessions significantly broaden the geographical scope of protection of industrial designs via the Hague System adding two of the world's most important economies and increasing the number of countries and intergovernmental organizations[1] (contracting parties) to 64.

The Hague Agreement Concerning the International Deposit of Industrial Designs, also known as the Hague system provides a mechanism for registering an industrial design in several countries by means of a single application, filed in one language, with one set of fees. The system is administered by WIPO.
